2. A NOTE TO USERS OUTSIDE OF THE UNITED STATES. YOUR PERSONAL DATA MAY BE PROCESSED IN THE COUNTRY IN WHICH IT WAS COLLECTED AND IN OTHER COUNTRIES, INCLUDING THE UNITED STATES, WHERE LAWS REGARDING PROCESSING OF PERSONAL DATA MAY BE LESS STRICT THAN THE LAWS IN YOUR COUNTRY.
3. TYPES OF DATA WE COLLECT. Generally you may visit the Website without providing your Personal Data. However, if you seek to use certain aspects of the Website, you will be required to provide Personal Data as described below. “Personal Data” means data that allows someone to identify or contact you, including, for example, your name, address, telephone number, e-mail address, as well as any other non-public information about you that is associated with or linked to any of that data. We do not intentionally gather Personal Data about visitors who are under the age of 13.
3.1 Personal Data You Provide to Us. To provide you an Account or access to certain features of our Website, we may collect Personal Data from you, such as your first and last name, email address, mailing addresses, phone number, business title, company, business sector, products in which you are interested, trade show attendance, and/or referral information. Any additional data or comments that you provide to us, whether by posting information to your profile page, posting comments or questions on our forums, providing feedback on our products or services, responding to our surveys, or otherwise, will be collected and used to provide you the Website services and for the other uses described below.
3.2 Personal Data Collected via Technology. To make our Website, products and services more useful to you, our servers may collect Personal Data from you, including your browser type, operating system, Internet Protocol (IP) address, domain name, and/or a date/time stamp of your visit. We may also use Cookies and navigational data like Uniform Resource Locators (URL) to gather information regarding the date and time of your visit and the solutions and information for which you searched and which you viewed. Like most Internet services, we would automatically gather this Personal Data and store it in log files each time you visit our Website. “Cookies” are small pieces of information that a website sends to your computer’s hard drive while you are viewing a website. If you choose to disable Cookies, some areas of our Website may not work properly.
4. USE OF YOUR DATA. In general, Personal Data you submit to us is used either to provide you the Website, respond to requests that you make, or to aid us in serving you better. We use your Personal Data in the following ways: to facilitate the creation of and secure your Account on our network; identify you as a user in our system; provide improved administration and quality of experience of our Website and other products and services; send you administrative e-mail notifications; respond to your inquiries and requests; for the marketing purposes of Cyan and/or Cyan’s third-party partners (including via email or telephone); to make telephone calls to you, from time to time, as a part of secondary fraud protection or to solicit your feedback. We may create anonymous data records from Personal Data by excluding information (such as your name) that makes the data personally identifiable to you. We use this anonymous data to analyze request and usage patterns so that we may enhance our Website, products and services, and for our marketing purposes. Cyan reserves the right to use and disclose anonymous data to any third party in its discretion.
5. DISCLOSURE OF YOUR PERSONAL DATA. We may share some or all of your Personal Data with our affiliates (e.g., parents, subsidiaries, or companies under common control), in which case we will require our affiliates to honor this Privacy Policy. If another company acquires our company or our assets, that company will possess the Personal Data collected by it and us and will assume the rights and obligations regarding your Personal Data as described in this Privacy Policy. We may share your Personal Data with our third-party service providers to assist in providing you with our Website, products or services or to facilitate the provision of certain services to us. These third-party service providers are prohibited from using your Personal Data other than to provide the services requested by Cyan. We may disclose Personal Data if we believe in good faith that such disclosure is necessary to (a) comply with relevant laws or to respond to subpoenas or warrants served on us; or (b) protect or defend our rights or property or users of our Website, products and/or services. If you register on our Website to receive marketing materials regarding our joint marketing events with our third‑party partners, we may share your Personal Data with our third-party partners for our joint marketing purposes and for their direct marketing purposes. The privacy policies of such third-party partners will apply to such third-party partners’ use and disclosure of your Personal Data that we collect and disclose to such third-party partners. You should contact the applicable third-party partner to obtain a copy of their privacy policy.
6. THIRD-PARTY SERVICES. When you click a link to a third-party website on our Website, you will leave our Website and enter the website of another party. The terms of this Privacy Policy do not apply to these outside websites, or to any collection of data after you leave our Website.
